Privacy Policy

Privacy issues are always a concern in our society.  We believe that personal information should remain private unless otherwise dictated by a justifiable need to know.  Our legal system supports the idea that people have an innate and acknowledged right to privacy until that right is forfeited by law.  This could involve being investigated by licensed agencies for crimes or civil wrongs or being the subject of a legal indebtedness.

The vast majority of our clients are professionals such as attorneys, law enforcement agencies, collection agencies and financial groups, all of whom have a “presumption of need” for a variety of information in their pursuit of lawful business purposes.  Our services contribute to the greater good of society assisting these professionals in their pursuit of lawful business purposes.

The rest of our clients are private citizens. These potential clients must demonstrate their “need to know” in order to qualify as clients.  Other professionals often refer these private citizens to us.  Occasionally sensitive personal information may be restricted or will be provided only to an attorney or other licensed professional. If this is the case, we will advise you of any restrictions on this information.

One common purpose for requesting information is for "judgment recovery" following a court order.  The civil court system does not always have the resources to assist creditors in the collection of a court-ordered award.  Our employment and asset searches provide creditors with a method of locating any assets a debtor might not have been inclined to disclose in court proceedings.

Our Contract and the Waiver And Release of Liability are the primary instruments for protecting the privacy of all parties concerned.  It may be necessary to sign other authorizations and releases that might be required for credit reports, some asset searches, motor vehicle and driving record searches. These forms specify the legal parameters for requesting the desired information.  We make every effort to ensure the legality of every search.

To the extent known by Clugston Polygraph and Investigative Services, all information is obtained via legal mechanisms only.  We use a variety of public and private sources widely used by law firms, investigators and the press.

We respect the rights of all citizens and institutions.  We operate without any intent to defraud, defame, harm or otherwise injure any party in any way.  It is our intention to comply fully with the federal Driver's Privacy Protection Act of 1994, the Gramm - Leach - Bliley Act of 1999, the Privacy Act of 1974, the Fair Credit Reporting Act and any other laws that pertain to the gathering and subsequent use of private information.  It is impossible to monitor every change in regulation or law in every political subdivision and jurisdiction.  It is our policy to comply with any and all legal limitations as we become aware of their existence.
